1. Acceptance of Terms

By accessing or using Superstack ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Fluxcode Studio LLC, operating as Superstack ("Superstack", "we", "us", or "our"), regarding your use of the Service.

2. Description of Service

Superstack is a token optimization service that reduces Claude API token usage through intelligent context injection, prompt caching, and output formatting. The Service includes:

Hook system for Claude Code integration
MCP server for IDE extensions
Cache proxy for API users
Dashboard and monitoring tools
Cloud subscription management

3. User Accounts

To access certain features, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Promptly notify us of any unauthorized use
Accept responsibility for all activities under your account

You must be at least 13 years old to use the Service. If you are under 18, you must have parental consent.

4. Subscription and Billing

4.1 Plans and Pricing

We offer the following subscription tiers:

Free: 1 optimized project, core optimization features (account required)
Pro ($12/month): Unlimited projects, full optimization, cloud sync
Team ($16/seat/month): Team dashboard, admin controls, API access
Enterprise (Custom): Unlimited devices, custom retention

4.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. Payments are processed by Polar. You authorize us to charge your payment method for all applicable fees.

4.3 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, your subscription remains active until the end of the current billing period.

4.4 Price Changes

We reserve the right to modify pricing with 30 days notice. Existing subscriptions will be honored at their current rate until renewal.

5. Acceptable Use

You agree not to:

Violate any applicable laws or regulations
Infringe on intellectual property rights
Attempt to bypass device limits or subscription restrictions
Reverse engineer, decompile, or disassemble the Service
Use the Service to transmit malware or malicious content
Share account credentials or subscription access
Resell or redistribute the Service without authorization
Interfere with the security or operation of the Service

6. Intellectual Property

The Service, including all code, design, and documentation, is owned by Fluxcode Studio LLC and protected by copyright and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

You retain ownership of your prompts and content. We do not claim any intellectual property rights over your data.

7. Third-Party Services

The Service integrates with third-party providers including:

Anthropic: Claude API for AI processing
Polar: Payment processing
GitHub/Google: OAuth authentication

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service availability or performance.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

Perform scheduled maintenance with reasonable notice
Suspend service for emergency maintenance
Modify or discontinue features with 30 days notice

9. Performance Disclaimers

Token savings are estimates, not guarantees. The optimization percentages displayed (e.g., "85-90% savings") are based on testing and typical usage patterns. Your actual savings may vary based on:

The nature of your prompts and workflows
Changes to third-party APIs (Anthropic, Claude)
Your specific usage patterns and project types
System updates and optimization algorithm changes

Third-party systems change. We rely on APIs from Anthropic and other providers. These providers may modify their systems, pricing, or token counting methods at any time, which may affect your savings.

User responsibility to monitor. You are responsible for monitoring your own token usage and savings through the dashboard and analytics tools we provide. If you notice unexpected behavior, please contact us promptly.

Best-effort support. While we cannot guarantee specific outcomes, we are committed to investigating issues and working with you to optimize your experience. We continuously improve our algorithms and will make reasonable efforts to address any concerns.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Fluxcode Studio LLC (d/b/a Superstack), its officers, directors, and employees from any claims, damages, or expenses arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights

12. Termination

We may suspend or terminate your access to the Service if you:

Violate these Terms
Fail to pay subscription fees
Engage in fraudulent activity
Create risk or legal exposure for us

Except in cases of fraud, abuse, or illegal activity (where we may terminate immediately), we will provide at least 30 days written notice before terminating your account. During the notice period, you may export your data and take any necessary steps to migrate.

Upon termination, your right to use the Service ends. Sections 6, 10, 11, 14, and 15 survive termination.

You may request deletion of your account and all associated data at any time through Settings or by contacting Contact us. See our Privacy Policy for details on data deletion and retention.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles.

14.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at Contact us and attempt to resolve the dispute informally for at least 30 days.

14.2 Binding Arbitration

If the dispute cannot be resolved informally, you and Fluxcode Studio LLC agree to resolve any claims through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will take place in the State of Ohio or, at your election, by phone or video conference.

The arbitrator's decision will be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

14.3 Class Action Waiver

YOU AND FLUXCODE STUDIO LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

14.4 Exceptions

Either party may bring claims in small claims court. Either party may seek injunctive relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

15. General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and Fluxcode Studio LLC (d/b/a Superstack)
Severability: If any provision is found invalid, the remainder remains in effect
Waiver: Failure to enforce any right does not constitute a waiver
Assignment: You may not assign these Terms without our consent
